CAMBODIA - 200 Koh Kong Families Need to Talk, to Resolve the Land Dispute

A London based law firm and the Cambodian Community Legal Education Centre (CLEC), who are representing 200 Koh Kong families involved in a legal dispute with the Koh Kong Sugar Industry Company, Koh Kong Plantation Company and UK sugar giant Tate & Lyle, have written to both Koh Kong companies inviting them to talks to try to resolve the dispute.

The families accuse the Koh Kong based companies of unlawfully dispossessing them of their land and accuse Tate & Lyle of subsequently profiting from the unlawful dispossession of their land. Leigh Day are representing the families in their UK proceedings against Tate & Lyle and T&L Sugars Ltd, and the Cambodian Community Legal Education Centre (CLEC) represents the families in proceedings in Cambodia against the Koh Kong based companies.

The letter sent this week asks the companies to participate in a formal mediation process, to be held in Cambodia before the end of the year, to explore whether a settlement can be reached. The letter was sent in response to one sent by the Koh Kong companies to other prominent Cambodian NGOs inviting them to witness their own “settlement and compensation session” in Koh Kong on 25th October. The letter, which was not sent to the lawyers representing the families, said that an unspecified amount of compensation would be offered at the meeting to villagers who could show a legitimate claim to the land on which the Koh Kong sugar plantation is based.
